Trader consensus favoring no criminal charges against OpenAI in 2026 at 58% reflects ongoing state-level scrutiny without formal indictments. Florida's April criminal investigation and June civil suit over ChatGPT's alleged role in the FSU shooting, plus multi-state subpoenas following the July Hugging Face AI agent breach, have intensified pressure around safety lapses and deceptive practices. However, these actions remain civil or investigatory, with no federal charges or indictments filed despite waves of private lawsuits tied to mass shootings. Key catalysts ahead include resolution of Florida's remanded case, outcomes from the 15-state records demands, and any escalation from the Hugging Face incident before year-end, though the high bar for corporate criminal liability in AI cases continues to anchor probabilities.
