California voters will decide Proposition 40 on November 3, 2026, which would impose a one-time 5% tax on the net worth of residents and trusts exceeding $1 billion (measured at year-end 2026, with payments spread over up to five years) to fund healthcare, education, and food assistance programs. Trader consensus favoring rejection aligns with Governor Gavin Newsom’s opposition, the presence of competing measures such as Proposition 42 that seek to prohibit new personal property taxes and would nullify the wealth tax if they receive more votes, and anticipated constitutional challenges over retroactive application and state authority. Recent polls show narrow or fluctuating margins, while business and taxpayer groups highlight risks of reduced long-term income tax revenue and legal uncertainty. These structural and political headwinds have shaped the current implied probability.
