**Trader consensus that James Comey will not be sentenced to prison in 2026 reflects the early procedural stage of his North Carolina federal case.** Indicted in April 2026 on charges of threatening the president and transmitting a threat, based on a 2025 Instagram post of seashells arranged as “86 47,” Comey faces arraignment on September 30 and trial on October 21. Pending defense motions seek dismissal on grounds including lack of a true threat, vindictive prosecution, and constitutional issues; a federal judge is weighing these filings. An earlier 2025 Virginia indictment was dismissed over the interim prosecutor’s appointment, with appeals ongoing. Standard timelines for sentencing—following any conviction, presentence reports, and hearings—make completion in the remaining months of 2026 improbable. The 97.4% implied probability on “No” aligns with these scheduling and legal realities. Late guilty pleas, unusually expedited proceedings, or rapid denial of all dismissal motions could theoretically alter timing, though such outcomes remain unlikely given the case posture.

This market will remain open through December 31, 2026 or until Comey is sentenced to time in jail/prison, regardless of any initial sentencing that does not include prison. Any sentencing will qualify, regardless of subsequent appeals or changes to the sentence.
Civil lawsuits, regulatory actions, administrative complaints, investigations without charges, internal employment actions, or public accusations without the filing of criminal charges will not qualify, even if widely reported or described colloquially as “charges.”
If at any point all charges against James Comey for all criminal cases are dropped for whatever reason, due to a plea agreement without an admission of guilt, a dismissal, or any other situation in which no judgement is rendered or will be rendered by the court, this market will resolve to "No".
The primary resolution source for this market will be official information from the relevant government and law enforcement; however a consensus of credible reporting may also be used.
