The recent mistrial declared on September 4 in Lindsay Clancy’s first-degree murder trial stands as the dominant driver behind the 93.5% market-implied probability that she will not receive a prison sentence this year. After roughly 38 hours of deliberations, the jury deadlocked on whether postpartum psychosis rendered her not criminally responsible for the 2023 deaths of her three children, leaving charges intact but yielding no verdict or sentencing timeline. Prosecutors must now decide on a retrial, with a status conference set for September 29 and any new proceedings likely stretching into late 2026 or beyond given court schedules and potential plea discussions. Clancy remains held without bail at Tewksbury State Hospital under civil commitment considerations. While a swift plea or dismissal could theoretically shift outcomes, the unresolved case and standard delays in Massachusetts criminal proceedings make a 2026 prison sentence highly improbable.

Ja
This market will resolve to "Yes" if Lindsay Clancy is sentenced to any term of incarceration stemming from the ongoing Commonwealth v. Lindsay Clancy case by either December 31, 2026, 11:59 PM ET or, in the event of a mistrial, by the end of any retrial (including possible sentencing proceedings) that begins before that date. Otherwise, this market will resolve to "No".
Any custodial sentence will qualify regardless of its length, regardless of the offense it is imposed for, and regardless of whether it is satisfied in whole or in part by credit for time already served. A sentence that is entirely suspended, a sentence of probation carrying no term of incarceration, a fine alone, or an order of commitment to a mental health facility will not qualify.
If this case ends due to a dismissal, or results in any situation in which no sentence is imposed by the court, or results in a verdict of Not Guilty on all charges (including by reason of lack of criminal responsibility due to mental illness), this market will resolve to "No". A plea agreement will qualify to resolve this market "Yes" only if it results in a sentence that includes a term of incarceration.
If all charges against Clancy are dropped, this market will immediately resolve to "No".
This market will resolve according to the initial sentence imposed in this case. Any appeals, or any later modification, reduction, or vacating of the sentence, will have no bearing on the resolution of this market.
The primary resolution source will be an official judgment delivered by the ruling court; however, other credible reporting may be used.
